These Terms of Service ("Terms") govern your use of the AI receptionist services and website provided by Axava LLC ("Axava," "we," "us," or "our"). By using our services, you agree to these Terms.
1. Services
Axava provides AI-powered receptionist services that answer phone calls, book appointments, and handle customer inquiries on behalf of your business. Our services include:
- AI voice receptionist that answers calls 24/7
- Appointment scheduling and management
- Call transcription and summaries
- Analytics dashboard
2. Account Registration
To use our services, you must:
- Provide accurate and complete registration information
- Maintain the security of your account credentials
- Notify us immediately of any unauthorized access
- Be at least 18 years old
You are responsible for all activities that occur under your account.
3. Subscription and Payment
Pricing:
- Monthly Plan: $749/month plus $1,500 setup fee
- 3-Month All-In Plan: $2,299 (includes setup, no additional fees)
Payment Terms:
- Payment is due at the beginning of each billing cycle
- Setup fees are non-refundable
- All fees are in US dollars
Cancellation:
- You may cancel your subscription at any time through your dashboard or by contacting support
- Cancellations take effect at the end of the current billing period
- No refunds for partial months
4. Acceptable Use
You agree not to use our services to:
- Violate any laws or regulations
- Transmit harmful, fraudulent, or deceptive content
- Impersonate others or misrepresent your business
- Interfere with or disrupt our services
- Use for any illegal telemarketing or spam calls
- Handle calls for illegal businesses or services
5. Phone Number and Call Forwarding
- You are responsible for configuring call forwarding from your existing business phone number to your assigned Axava number
- You retain ownership of your existing business phone number
- We provide you with a dedicated Twilio number for receiving forwarded calls
6. Call Recording Consent
By using our services, you acknowledge that:
- All calls handled by our AI receptionist are recorded and transcribed
- You are responsible for complying with call recording laws in your jurisdiction
- You must notify callers that calls may be recorded if required by applicable law
7. Intellectual Property
- Axava retains all rights to our AI technology, software, and platform
- You retain ownership of your business data and customer information
- Call recordings and transcripts are your property but are processed using our technology
8. Service Availability
- We strive for 99.9% uptime but do not guarantee uninterrupted service
- Scheduled maintenance will be communicated in advance when possible
- We are not liable for downtime caused by third-party services (Twilio, AWS, etc.)
9. Limitation of Liability
To the maximum extent permitted by law:
- Axava is not liable for any indirect, incidental, or consequential damages
- Our total liability is limited to the amount you paid us in the 3 months prior to the claim
- We are not responsible for missed calls, lost appointments, or business losses resulting from service issues
10. Indemnification
You agree to indemnify and hold Axava harmless from any claims, damages, or expenses arising from:
- Your use of our services
- Your violation of these Terms
- Your violation of any third-party rights
11. Modifications
We may update these Terms from time to time. Continued use of our services after changes constitutes acceptance of the new Terms. Material changes will be communicated via email.
12. Termination
We may suspend or terminate your account if you:
- Violate these Terms
- Fail to pay fees when due
- Use our services for illegal purposes
13. Governing Law
These Terms are governed by the laws of the State of Ohio, USA. Any disputes shall be resolved in the courts of Ohio.
